These terms apply to your use of zennalatexmattress.com.au and to any order you place with us. Please read them before ordering. By placing an order you agree to them.

2. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights apply in addition to any voluntary guarantee we offer, and they can last longer than that guarantee. If something goes wrong with your mattress after our guarantee period has ended, contact us anyway.

3. Placing an order

When you place an order you are making an offer to buy from us. We accept your order when we send you an order confirmation by email. If we cannot accept your order we will contact you and refund any payment in full.

We may decline an order where the product is unavailable, where there has been a pricing or description error, or where we are unable to deliver to your address.

4. Prices and payment

All prices are in Australian dollars and include GST unless stated otherwise.

We accept the payment methods shown at checkout, which currently include credit and debit card, PayPal, Afterpay, and Zip. Buy now pay later services are provided by those companies under their own terms, and your agreement for that finance is with them, not with us.

Payment is taken at the time of order. Your order will not be dispatched until payment has cleared.

We try to keep prices and product information accurate. If we discover an error in the price or description of something you have ordered, we will contact you before dispatch and you may continue with the order at the correct price or cancel it for a full refund.

5. Delivery

Delivery costs, timeframes and areas are set out on our Shipping, Returns and Exchanges page, which forms part of these terms.

Delivery timeframes are estimates. We are not responsible for delays caused by the carrier, weather, or events outside our reasonable control, but we will keep you informed and help resolve any problem.

Risk in the goods passes to you on delivery. If your order arrives damaged, tell us as soon as possible so we can put it right.

6. Changing or cancelling an order

Contact us as soon as possible if you need to change or cancel an order. If it has not yet left our warehouse we will usually be able to help. Once an order has been dispatched, our returns and trial terms apply instead.

This does not affect your rights where goods are faulty or not as described.

7. Comfort trial, returns and exchanges

Our comfort trial, returns process and exchange process are set out on the Shipping, Returns and Exchanges page, which forms part of these terms. That page tells you what the trial covers, what conditions apply, and what any return costs.

Those terms are in addition to your rights under the Australian Consumer Law, not instead of them.

8. Guarantee

Our mattress guarantee is set out on the Warranty page, which forms part of these terms.

9. Product information and images

We describe our products as accurately as we can. Photographs are indicative. Natural latex is a natural material, so small variations in colour, surface finish and firmness are normal and are not defects.

Dimensions are approximate and small manufacturing tolerances apply.

10. Using this website

You may use this website for lawful purposes only. You must not attempt to interfere with it, gain unauthorised access to it, or use it in a way that could damage or disrupt it.

We try to keep the website available and accurate, but we do not guarantee it will always be available or error free.

11. Intellectual property

All content on this website, including text, images, video, logos and design, is owned by us or used with permission. You may not copy, reproduce or use it commercially without our written consent.

12. Our liability

Nothing in this section limits your rights under the Australian Consumer Law or our liability for death or personal injury caused by our negligence, or for fraud.

Subject to that, we are not liable for loss that was not reasonably foreseeable, or for business losses.

13. Privacy

We handle your personal information in accordance with our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones published on this website when you placed it.

15. Governing law

These terms are governed by the laws of New South Wales, Australia.
